Notes for Business Executives

A Warning to Creditors on Bankruptcy Reform

NOTE 1751: Much of the analysis of pending bankrupt-legislation reform has focused on the effects the reform may have on debtors. While the aim of the bills in the House and the Senate is to make it tougher to escape debts, some analysts have also pointed to the potential negative effects the bill could have on creditors. Among the provisions are those that would limit a judge's discretion in establishing or extending certain deadlines. An imposition of artificial deadlines could make it harder for some debtors, particularly when they're small businesses, to reorganize. Deadlines could also force debtors that are liquidating to try to sell off assets when market conditions are down rather than waiting for the economy to pick up again.
